4、China,theFoodSafetyLawofthePeoplesR即UbIiCofChina(uFoodSafetyLaw),theRegulationontheImplementationoftheFoodSafetyLawofthePeoplesRepublicofChina,andotherapplicablelawsandregulationsforthepurposesofregulatingtheregistrationofformulafoodforspecialmedicalpurposesandensuringthequality法规，制定本办法。andsafetyoff

5、ormulafoodforspecialmedicalpurposes.Article2TheseMeasuresshallapplytotheadministrationofregistrationofformulafoodforspecialmedicalpurposesproducedandsoldwithinandimportedtotheterritoryofthePeoplesRepublicofChina.Article3Theregistrationofformulafoodforspecialmedicalpurposesmeanstheactivitiesinwhichth

6、eStateAdministrationforMarketRegulation(uSAMR),accordingtotheproceduresandrequirementsasprescribedintheseMeasures,examinestheapplicationsfortheregistrationofformulafoodforspecialmedicalpurposesanddecideswhethertoapproveregistration.Article4Theadministrationofregistrationofformulafoodforspecialmedica

7、lpurposesshallbebasedontheclinicaldemandsfornutrition,followtheprinciplesofScientificity,openness,fairness,andimpartiality,andencourageinnovation.Article5TheSAMRshallberesponsibleforadministeringtheregistrationofformulafoodforspecialmedicalpurposes.第二条在中华人民共 和国境内生产销售和进口的 特殊医学用途配方食品的注 册管理，适用本办法。第三条特殊

8、医学用途 配方食品注册，是指国家市 场监督管理总局依据本办法 规定的程序和要求，对申请 注册的特殊医学用途配方食 品进行审查，并决定是否准 予注册的活动。第四条特殊医学用途 配方食品注册管理，以临床 营养需求为导向，遵循科 学、公开、公平、公正的原 则，鼓励创新。第五条国家市场监督 管理总局负责特殊医学用途 配方食品的注册管理工作。国家市场监督管理总局食品 审评机构（食品审评中心， 以下简称审评机构）负责特 殊医学用途配方食品注册申 请的受理、技术审评、现场ThefoodevaluationinstitutionoftheSAMR(uCenterforFoodEvaluation,herein

9、afterreferredtoastheevaluationinstitution”)shallberesponsibleforsuchworkasacceptingapplicationsfortheregistrationofformulafoodforspecialmedicalpurposes,conductingtechnicalevaluationandon-siteinspection,preparinganddeliveringcertificates,andorganizingexpertdemonstrationasneeded.Themarketregulatorydep

10、artmentsofprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernmentshallcooperateinsuchworkastheon-siteinspectionfortheregistrationofformulafoodforspecialmedicalpurposes.Article6Anapplicantfortheregistrationofformulafoodforspecialmedicalpurposes(applicant)shallberesponsibleforth

11、everacity,completeness,legitimacy,andtraceabilityofthematerialssubmittedbyitandassumelegalliability.Theapplicantshallcooperatewiththemarketregulatorydepartmentinconductingon-siteinspection,samplinginspection,andotherworkrelatedtoregistration,andprovidenecessaryworkingconditions.Chapter II Applicatio

12、nandRegistration核查、制证送达等工作，并 根据需要组织专家进行论 证。省、自治区、直辖市市场监 督管理部门应当配合特殊医 学用途配方食品注册的现场 核查等工作。第六条特殊医学用途 配方食品注册申请人（以下 简称申请人）应当对所提交 材料的真实性、完整性、合 法性和可溯源性负责，并承 担法律责任。申请人应当配合市场监督管 理部门开展与注册相关的现 场核查、抽样检验等工作， 提供必要的工作条件。第二章申请与注册第七条申请人应当为 拟在中华人民共和国境内生 产并销售特殊医学用途配方 食品的生产企业或者拟向中 华人民共和国出口特殊医学 用途配方食品的境外生产企 业。Article7An

13、applicantshallbeaproductionenterpriseintendingtoproduceandsellformulafoodforspecialmedicalpurposeswithintheterritoryofthePeoplesRepublicofChinaoranoverseasproductionenterpriseintendingtoexportformulafoodforspecialmedicalpurposestothePeoplesRepublicofChina.Anapplicantshallhavetheresearchanddevelopmen

14、tcapacity,productioncapacity,andinspectioncapacitysuitablefortheproducedformulafoodforspecialmedicalpurposes,establishtheresearchanddevelopmentinstitutionforformulafoodforspecialmedicalpurposes,establishaproductionqualitymanagementsystemsuitablefortheproducedformulafoodforspecialmedicalpurposesaccor

15、dingtotherequirementsofGoodManufacturingPracticeandinspectallex-factoryproductsinbatchesaccordingtotheitemsspecifiedintherelevantlawsandregulations,nationalfoodsafetystandards,andtechnicalrequirements.Aresearchanddevelopmentinstitutionshallbestaffedbypersonnelwithseniorprofessionaltitlesinfood-relat

16、edfieldsorcorrespondingprofessionalcompetence.Article8ThefollowingmaterialsshallbesubmittedtotheSAMRinanapplicationfortheregistrationofformulafoodforspecialmedicalpurposes:申请人应当具备与所生产特 殊医学用途配方食品相适应 的研发能力、生产能力、检 验能力，设立特殊医学用途 配方食品研发机构，按照良 好生产规范要求建立与所生 产特殊医学用途配方食品相 适应的生产质量管理体系， 对出厂产品按照有关法律法 规、食品安全国家标准和技 术要求规定的项目实施逐批 检验。研发机构中应当有食品相关 专业高级职称或者相应专业 能力的人员。第八条申请特殊医学 用途配方食品注册，应当向 国家市场
