NoticebytheGeneralOfficeoftheStateCouncilofMattersConcerningComprehensiveAdministrativeEnforcementforEmergencyManagementDocumentNumber：LetterNo.512023oftheGeneralOfficeoftheStaleCouncilAreaofLaw:GeneralProvisionsonLegislativeAffairs1.evelofAuthority：RegulatoryDocumentsoftheStateCouncilIssuingAuthority：GeneralOfficeoftheStateCouncilDateIssued：07-05-2023EffectiveDate:07-05-2023Status：EffectiveTopicEmergenciesNoticebyIheGeneralOfficeoftheStaleCouncilofMattersConcerningComprehensiveAdministrativeEnforcementforEmergencyManagement(LetterNo.512023oftheGeneralOfficeoftheStateCouncil)Thepeople'sgovernmentsofallprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernment;andallministriesandcommissionsoftheStateCouncilandallinstitutionsdirectlyundertheStateCouncil:ForthepurposesofthoroughlyimplementingtheNoticebytheGeneralOfficeoftheCPCCentralCommitteeandtheGeneralOfficeoftheStateCouncilofDeepeningtheReformofComprehensiveAdministrativeLawEnforcementforEmergencyManagementandacceleratingtheconstructionofanauthoritativeandefficientcomprehensiveadministrativelawenforcementsystemforemergencymanagementfeaturing国务院办公厅关于应急管理综合行政执法有关事项的通知(国办函(2023)51号)各省、自治区、直辖市人民政府，国务院各部委、各直属机构：为深入贯彻落实中共中央办公厅国务院办公厅印发关于深化应急管理综合行政执法改革的意见的通知，加快构建权责一致、权威高效的应急管理综合行政执法体制，经国务院同意，现就有关事项通知如下：consistentpowersandresponsibilities,withtheconsentoftheStateCouncil,youareherebynotifiedoftherelevantmattersasfollows:I.Generalrequirements.UndertheguidanceofXiJinpingThoughtonSocialismwithChineseCharacteristicsforaNewEra,inaccordancewiththedecisionsandarrangementsoftheCPCCentralCommitteeandtheStaleCouncil,thereformofintegratedadministrativelawenforcementforemergencymanagementshallbesteadilypromoted,theallocationofadministrativelawenforcementfunctionsandresourcesshallbecoordinatedinanoverallmanner,theproblemsofrepeatedlawenforcementbymultiplepartiesatmultiplelevelsshallbeeffectivelyresolved,andfairandcivilizedlawenforcementshallbestrictlystandardized.11.Preparingaunifiedcatalogue.Administrativepenaltiesandadministrativecompulsorymatterssetintheemergencymanagementfieldaccordingtolawsandadministrativeregulations,andadministrativepenaltymattersofwarningandfinesetaccordingtodepartmentalrulesshallhesortedoutandstandardized,theGuidingCatalogueforComprehensiveAdministrativeLawEnforcementMattersforEmergencyManagement(hereinafterreferredtoasthettGuidingCatalogue'')shallbeprepared,anddynamicadjustmentsshallbemadeaccordingtoprocedures.Theimplementationofadministrativepenaltyandadministrativecompulsorymattersshallbebasedonlaws,regulationsandrulescurrentlyinforce,anddoesnotinvolvethecontentofincreasingtheresponsibilityoftheadministrativecounterpart.WheretheadministrativelawenforcementmattersintheGuiding一、总体要求。以习近平新时代中国特色社会主义思想为指导，按照党中央、国务院决策部署，扎实推进应急管理综合行政执法改革，统筹配置行政执法职能和执法资源，切实解决多头多层重复执法问题，严格规范公正文明执法。二、编制统一目录。梳理规范应急管理领域依据法律、行政法规设定的行政处罚和行政强制事项，以及部门规章设定的警告、罚款的行政处罚事项，编制应急管理综合行政执法事项指导目录（以下简称指导目录），并按程序进行动态调整。行政处罚和行政强制事项的实施依据均为现行有效的法律法规规章原文，不涉及增加行政相对人责任义务等内容。指导目录中的行政执法事项涉及相关部门职责的，由相关部门根据法律、行政法规、部门规章的规定依法实施。各省、自治区、直辖市可以根据法律、行政法规、部门规章立改废释和地方立法等情况，对有关事项进行补充、细化和完善，建立动态调整和长效管理机制。有关事项按程序审核确认后，要在政府门户网站等载体上以适当方式公开，接受社会监督。Catalogueinvolvetheresponsibilitiesofrelevantdepartments,theyshallbeimplementedbyrelevantdepartmentsaccordingtolaws,administrativeregulationsanddepartmentalrules.Provinces,autonomousregionsandmunicipalitiesdirectlyunderthecentralgovernmentmaysupplement,refineandimproverelevantmattersinaccordancewiththedevelopment,revision,repealingandinterpretationoflaws,administrativeregulations,departmentalrulesandlocallegislation,andestablishdynamicadjustmentandlong-termmanagementmechanisms.Aftertherelevantmattershavebeenreviewedandconfirmedaccordingtoprocedures,theyshallbedisclosedinanappropriatemannerongovernmentportalwebsitesandothercarriersforpublicsupervision.三、加强源头治理。对应急管理领域行政处罚和行政 强制事项，凡没有法律法规规章依据的行政执法事项一律 取消。需要保留或者新增的行政执法事项，要依法逐条逐 项进行合法性、合理性和必要性审查。虽有法定依据但长 期未发生且无实施必要的、交叉重复的行政执法事项，要 大力清理，及时提出取消或者调整的意见建议。需修改法 律法规规章的，要按程序先修法再调整指导目录，先 立后破，有序推进。III. Strengtheningsourcecontrol.Foradministrativepenaltiesandadministrativecompulsorymattersinthefieldofemergencymanagement,alladministrativelawenforcementmattersthathavenobasisinlaws,regulationsandregulationsshallbecanceled.Thelegality,rationalityandnecessityofadministrativelawenforcementmattersthatneedtoberetainedoraddedshallbeexamineditembyiteminaccordancewiththelaw.Administrativelawenforcementmatterswithalegalbasisthathavenotoccurredforalongtime,thatareunnecessarytobeimplemented,andthatarecross-repeatedshallbevigorouslyreviewed,andopinionsandsuggestionsforcancellationoradjustmentshallbeputforwardinatimelymanner.Ifanylaw,regulation,orruleneedstoberevised,revisionsshallbemadeunderproceduresbeforetheGuidingCatalogueisupdatedsoastoensuretheorderlyadvancementoflawenforcementitems.IV.
