DocumentNumber：OrderNo.733oftheStateCouncilofthePeople'sRepublicofChinaAreaofLau:GeneralProvisionsonGovernmentAffairs1.evelofAuthority：AdministrativeRegulationsIssuingAuthority：StateCouncilDateIssued：12-26-2020EffectiveDale02-01-2021Status:EffectiveOrderoftheStateCouncilofthePeople'sRepublicofChina(No.733)TheRegulationonGovernments'SupervisoryInspection,asadoptedatthe116thexecutivemeetingoftheStateCouncilonDecember1,2020,isherebyissued,andshallcomeintoforceonFebruary1,2021.Premier:LiKeqiangDecember26,2020RegulationonGovernments'SupervisoryInspectionArticle1ThisRegulationhasbeendevelopedforthepurposesofstrengtheningandregulatinggovernments'supervisoryinspection,guaranteeingthesmoothimplementationofgovernmentorders,enhancingadministrativeefficiency,promotinggovernmentintegrity,and中华人民共和国国务院令（第733号）政府督查工作条例已经2020年12月1日国务院第116次常务会议通过，现予公布，自2021年2月1日起施行。总理李克强2020年12月26日政府督查工作条例第一条为了加强和规范政府督查工作，保障政令畅通，提高行政效能，推进廉政建设，健全行政监督制度，制定本条例。improvingtherulesofadministrativesupervision.Article2ForthepurposesofthisRegulation,theterm'governments'supervisoryinspection1referstosupervisionandinspectionorganizedbypeople'sgovernmentsatorabovethecountylevelwithinthescopeoftheirstatutorypowersasrequiredforwork.Article3Governments'supervisoryinspectionshalladheretoandstrengthentheleadershipoftheParty,bepeople-oriented,suittheoverallsituation,seektruthfromfacts,promoteadministrationbylaw,promotetheimplementationofpoliciesandthesettlementofproblems,andavoidformalismandbureaucratism.Article 4 Thecontentsofgovernments'supervisoryinspectionshallinclude:(1) implementationofmajordecisionsandarrangementsoftheCPCCentralCommitteeandtheStateCouncil;(2) implementationoftheessentialworkarrangementsofpeople'sgovernmentsalhigherlevelsandatthesamelevel;(3) performanceofstatutorydutiesbythesubjectsofsupervisoryinspection;and(4) administrativeefficiencyofdepartmentsofpeople'sgovernmentsatthesamelevelandpeople'sgovernmentsatlowerlevels.第二条本条例所称政府督查，是指县级以上人民政府在法定职权范围内根据工作需要组织开展的监督检查。第三条政府督查工作应当坚持和加强党的领导，以人民为中心，服务大局、实事求是，推进依法行政，推动政策落实和问题解决，力戒形式主义、官僚主义。第四条政府督查内容包括：（一）党中央、国务院重大决策部署落实情况；（二）上级和本级人民政府重要工作部署落实情况；（三）督查对象法定职责履行情况；（四）本级人民政府所属部门和下级人民政府的行政效能。Article 5 Thesubjectsofgovernments'supervisoryinspectioninclude:(1) departmentsofpeople'sgovernmentsatthesamelevel;(2) people'sgovernmentsallowerlevelsandtheirdepartments;(3) organizationsauthorizedbylawsandregulationstoperformthefunctionofadministeringpublicaffairs;and(4) organizationsentrustedbyadministrativeagenciestoadministerpublicaffairs.Thepeople'sgovernmentatahigherlevelmayconductsupervisoryinspectionofthepeople'sgovernmentatalowerlevelanditsdepartments,andmay,whennecessary,conductsupervisoryinspectionofpeople'sgovernmentsatalllevelsandtheirdepartmentsunderitsjurisdiction.Article 6 TheGeneralOfficeoftheStateCouncilshallguidethesupervisoryinspectionofgovernmentsnationwideandorganizethesupervisorj,inspectionoftheStateCouncil.ThesupervisoryinspectionbodyoftheGeneralOfficeoftheStateCouncilshallundertakespecificworkrelatedtothesupervisoryinspectionoftheStateCouncil.Thesupervisoryinspectionbodiesoflocalpeople'sgovernmentsatorabovethecountylevelshallorganizethesupervisoryinspectionofpeople'sgovernmentsatthesamelevel.Thefbnsandspecificationsforthesetupofsupervisory第五条政府督查对象包括：（一）本级人民政府所属部门；（二）下级人民政府及其所属部门；（三）法律、法规授权的具有管理公共事务职能的组织；（四）受行政机关委托管理公共事务的组织。上级人民政府可以对下一级人民政府及其所属部门开展督查，必要时可以对所辖各级人民政府及其所属部门开展督查。第六条国务院办公厅指导全国政府督查工作，组织实施国务院督查工作。国务院办公厅督查机构承担国务院督查有关具体工作。县级以上地方人民政府督查机构组织实施本级人民政府督查工作。县级以上地方人民政府督查机构设置的形式和规格，按照机构编制管理有关规定办理。inspectionbodiesoflocalpeople,sgovernmentsatorabovethecountylevelshallbegovernedbytheprovisionsontheadministrationofinstitutionsetup.ThesupervisoryinspectionbodiesoftheGeneralOfficeoftheStateCouncilandlocalpeople'sgovernmentsatorabovethecountylevelarecollectivelyreferredtoasthegovernments'supervisoryinspectionbodies.Article7Thepeople'sgovernmentsatandabovethecountylevelmaydesignatetheirdepartmentstoconductgovernments'supervisoryinspectionaccordingtothedesignatedmatters,scope,dutiesandtimelimit.Thedepartmentsofpeople'sgovernmentsatandabovethecountylevelshallnotconductthegovernments'superqsoryinspectionwithoutdesignationbypeople'sgovernmentsatthesamelevel.Article8Thepeople'sgovernmentatorabovethecountylevelmaydispatchasupervisoryinspectiongroupasrequiredforwork.Thesupervisoryinspectiongroupshallconductthegovernment'ssupervisorj,inspectionaccordingtosupervisoryinspectionmatters,scope,dutiesandtimelimitdeterminedbythepeople'sgovernmentatthesamelevel.Thesupervisoryinspectiongroupshallberesponsibletothepeople,sgovernmentatthesamelevel.Thegroupleadershallassumetheoverallresponsibilityforthesupervisoryinspectiongroupandshallbedeterminedbythepeople'sgovernmentatthesamelevel.国务院办公厅督查机构和县级以上地方人民政府督查机构统称政府督查机构。第七条县级以上人民政府可以指定所属部门按照指定的事项、范围、职责、期限开展政府督查。县级以上人民政府所属部门未经本级人民政府指定，不得开展政府督查。第八条县级以上人民政府根据工作需要，可以派出督查组。督查组按照本级人民政府确定的督查事项、范围、职责、期限开展政府督查。督查组对本级人民政府负责。督查组实行组长负责制，组长由本级人民政
