供港澳食用陆生动物检验检 疫管理办法（2024年1月22日海关总 署令第266号公布 自2024 年3月1日起实施）第一章总则第一条为了做好供港 澳食用陆生动物检验检疫工 作，防止动物疫病传播，保 障供港澳食用陆生动物卫生 和食用安全，根据中华人 民共和国进出境动植物检疫 法及其实施条例、中华 人民共和国食品安全法及 其实施条例、中华人民共供港澳食用陆生动物检验检疫管理办法AdministrativeMeasuresfortheInspectionandQuarantineofEdibleTerrestrialAnimalsSuppliedtoHongKongandMacao制定机关：海关总署发文字号：海关总署令第266号公布日期：2024.01.22施行日期:2024.03.01效力位阶：部门规章法规类别：进出口商品检验IssuingAuthority：GeneralAdministrationofCustomsDocumentNumber：OrderNo.266oftheGeneralAdministrationofCustomsDateIssued：01-22-2024EffectiveDate：03-01-20241.evelofAuthority：DepartmentalRulesAreaofLawImportandExportCommodityInspectionAdministrativeMeasuresfortheInspectionandQuarantineofEdibleTerrestrialAnimalsSuppliedtoHongKongandMacao(IssuedbyOrderNo.266oftheGeneralAdministrationofCustomsonJanuary22,2024,comingintoforceonMarch1,2024)Chapter I GeneralProvisionsArticle1TheseMeasuresaredevelopedinaccordancewiththeLawofthePeople,sRepublicofChinaontheQuarantineofEntryandExitAnimalsandPlantsandtheregulationonitsimplementation,theFoodSafetyLawofthePeople'sRepublicofChinaandtheregulationonitsimplementation,theBiologicalSafetyLawofthePeople'sRepublicofChina,theAnimalEpidemicPreventionLawofthePeople'sRepublicofChina,andotherapplicablelawsandadministrativeregulationsforthepurposesofeffectivelyconductingtheinspectionandquarantineofedibleterrestrialanimalssuppliedtoHongKongandMacao,preventingthespreadofanimalepidemics,andguaranteeingthehealthandfoodsafetyofedibleterrestrialanimalssuppliedtoHongKongandMacao.Article2TheGeneralAdministrationofCustoms(uGACn)shalluniformlyadministertheinspectionandquarantineofedibleterrestrialanimalssuppliedbytheMainlandtoHongKongandMacaoandthesupervisionandadministrationthereof.CustomsatalllevelsshallberesponsiblefortheinspectionandquarantineofedibleterrestrialanimalssuppliedtoHongKongandMacaoandthesupervisionandadministrationthereofwithintheirrespectivejurisdictions.Article3Anyentityorindividualengagedinactivitiessuchasthebreeding,transport,transit,andtradingofedibleterrestrialanimalssuppliedtoHongKongandMacaoshallabidebytheseMeasures,acceptthesupervisionandadministrationoftheCustomsinaccordancewiththelaw,fulfilltheirprimaryresponsibilitiesforanimalepidemicpreventionandproductqualitysafety,undertakesocialresponsibilities,andensurethehealthandfoodsafetyofedibleterrestrialanimalssuppliedtoHongKongandMacao.Article4TheCustomsshallimprovethelevelofinspectionandquarantineofedibleterrestrialanimalssuppliedtoHongKongandMacaoandthesupervisionandadministrationthereofthroughriskmanagementandinformationtechnology-basedmeans.和国生物安全法、中华 人民共和国动物防疫法等 法律、行政法规的规定，制 定本办法。第二条海关总署统一 管理内地供港澳食用陆生动 物的检验检疫和监督管理工 作。各级海关负责所辖区域供港 澳食用陆生动物的检验检疫 和监督管理工作。第三条从事供港澳食 用陆生动物饲养、运输、中 转、贸易等活动的单位和个 人应当遵守本办法，依法接 受海关的监督管理，履行动 物防疫和产品质量安全主体 责任，承担社会责任，确保 供港澳食用陆生动物卫生和 食用安全。第四条海关运用风险 管理和信息化手段，提升供 港澳食用陆生动物检验检疫 和监督管理水平。第二章注册登记Chapter II RegistrationArticle 5 TheCustomsshallmanagetheregistrationofbreedingfarmsofedibleterrestrialanimalssuppliedtoHongKongandMacao("breedingfarms").Registrationshallbecarriedoutonafarm-by-farmbasis,withonecertificateforeachfarm,andtheregistrationnumbershallbeusedexclusivelyforaspecificfarm.EdibleterrestrialanimalsraisedbyanyunregisteredbreedingfarmshallnotbesuppliedtotheHongKongSpecialAdministrativeRegionortheMacaoSpecialAdministrativeRegion.Article 6 Toregisterabreedingfarm,thefollowingrequirementsshallbemet:(1) Havingthequalificationofabusinessentity.(2) Havingobtainedthecertificateofcompliancewithanimalepidemicpreventionconditionsissuedbythedepartmentofagricultureandruralaffairs.(3) Thesiteselection,breedingscale,breedingmode,partitionlayout,facilitiesandequipment,managementrules,andanimalepidemicpreventionconditions,amongothers,ofthebreedingfarmcomplywiththerulesoftheCustoms,andthespecificrequirementsthereofshallbeseparatelydevelopedbytheGAC.第五条海关对供港澳 食用陆生动物饲养场（以下 简称“饲养场”）实行注册 登记管理。注册登记以饲养场为单位， 一场一证，注册登记编号应 专场专用。饲养场未经注册登记的，其 饲养的食用陆生动物不得供 应香港、澳门特别行政区。第六条饲养场注册登 记应当符合以下条件：（一）具有经营主体资格;（二）取得农业农村部门颁 发的动物防疫条件合格证；（三）饲养场的选址、饲养 规模、饲养模式、分区布 局、设施设备、管理制度、 动物防疫条件等符合海关规 定，具体要求由海关总署另 行制定。饲养场不具备经营主体资格 的，应当由经营该饲养场的 经营主体申请注册登记。Ifthebreedingfarmdoesnothavethequalificationsofabusinessentity,theapplicationforregistrationshallbefiledbythebusinessentityoperatingthefarm.Article 7 AbreedingfarmshallfileanapplicationforregistrationwiththelocalCustomsbysubmittinganapplicationformforregistrationandaplanefigureofthefarm.TheCustomsdirectlyundertheGACattheplacewherethebreedingfarmislocatedshallexaminematerialsandconducton-siteexamination.Ifregistrationconditionsaremet,itshalldecidetograntadministrativelicensinginaccordancewiththelawandissuetheregistrationcertificateofthebreedingfarm;orifregistrationconditionsarenotmet,itshallmakeadecisionnottogranttheadministrativelicensinginaccordancewiththelaw.Article 8 Incaseofachangeintheaddress(excludingrelocation),thetypeofbusinessentity,thename,legalrepresentative,orpersoninchargeofaregisteredbreedingfarm,orincaseofachangeintheregist
