行业标准管理办法(2023)MeasuresfortheAdministrationofIndustryStandards(2023)制定机关：国家市场监督管理总局发文字号：国家市场监督管理总局令第86号公布日期：2023.11.28施行日期：2024.06.01效力位阶：部门规章法规类别：行业标准管理IssuingAuthority：StateAdministrationforMarketRegulationDocumentNumber：OrderNo.86(2023oftheStateAdministrationforMarketRegulationDateIssued：11-28-2023EffectiveDate：06-01-20241.evelofAuthority：DepartmentalRulesAreaofLaw:AdministrationofIndustryStandards行业标准管理办法MeasuresfortheAdministrationofIndustryStandards(2023)（2023年11月28日国家市场监 督管理总局令第86号公布 自 2024年6月1日起施行）(IssuedbyOrderNo.86oftheStateAdministrationforMarketRegulationonNovember28,2023,comingintoforceonJune1,2024)第一条为了加强行业标准 管理，根据中华人民共和国标 准化法，制定本办法。第二条行业标准的制定、 组织实施及其监督管理，适用本 办法。Article 1 Forthepurposesofstrengtheningtheadministrationofindustrystandards,theseMeasuresaredevelopedinaccordancewiththeStandardizationLawofthePeople'sRepublicofChina.Article 2 TheseMeasuresapplytothedevelopment,implementation,supervision,andadministrationofindustrystandards.第三条行业标准是国务院 有关行政主管部门依据其行政管Article 3 IndustrystandardsarestandardsthataredevelopedbytherelevantadministrativedepartmentsoftheStateCouncilaccordingtotheiradministrativedutiesfortechnicalrequirementsthathavenorecommendednationalstandardbutneedtobeunifiedindustry-wideinChina.Anindustrystandardismainlydevelopedaccordingtothedemandfromimportantproducts,engineeringtechnology,services,andindustryregulationintheindustry.理职责，对没有推荐性国家标准 而又需要在全国某个行业范围内 统一的技术要求所制定的标准。行业标准重点围绕本行业领域重 要产品、工程技术、服务和行业 管理等需求制定。有下列情形之一的，不应当制定 行业标准：Noindustrystandardshallbedevelopedinanyofthefollowingcircumstances:(1)Thereisarecommendednationalstandard;（一）已有推荐性国家标准的;（二）要求；一般性产品和服务的技术(3) There are cross-departmental, industry technical requirements; orcross-（三） 求；跨部门、跨行业的技术要(2)Therearethetechnicalrequirementsforgeneralproductsandservices;（四）用于约束行政主管部门系 统内部的工作要求、管理规范 等。第四条行业标准是推荐性 标准。法律、行政法规和国务院 决定另有规定的，从其规定。第五条制定行业标准应当 在科学技术研究成果和社会实践 经验的基础上，保证行业标准的 科学性、规范性、时效性，做到 技术上先进、经济上合理。(4)Thereareworkrequirementsandmanagementnormsusedtorestricttheinternalaffairswithintheadministrativedepartment.Article4Anindustrystandardisarecommendedstandard,exceptasotherwiseprovidedforbyanylaw,administrativeregulation,ordecisionoftheStateCouncil.Article5ThedevelopmentofindustrystandardsshallbebasedonscientificandtechnologicalresearchachievementsandsocialpracticalexperiencetoensuretheScientificity,standardization,andtimelinessofindustrystandards,sothattheyaretechnologicallyadvancedandeconomicallyreasonable.第六条行业标准的技术要 求不得低于强制性国家标准的相 关要求，并与有关标准协调配 套。Article6Thetechnicalrequirementsofindustrystandardsshallnotbelowerthantherelevantrequirementsofmandatorynationalstandards,andshallbecoordinatedwithrelevantstandards.禁止在行业标准中规定资质资 格、许可认证、审批登记、评比 达标、监管主体和职责等事项。Itisforbiddentospecifyqualifications,licensingandcertification,examinationandapprovalregistration,performanceevaluationandinspection,regulators,andresponsibilitiesinindustrystandards.禁止利用行业标准实施妨碍商 品、服务自由流通等排除、限制 市场竞争的行为。Itisforbiddentouseindustrystandardstohinderthefreeflowofgoodsandservicesorcommitactivitiesthatexcludeorrestrictmarketcompetition.第七条国务院标准化行政 主管部门统一指导、协调、监督 行业标准的制定及相关管理工 作。国务院标准化行政主管部门 建立全国标准信息公共服务平 台，支撑行业标准备案、信息公 开等工作。Article7ThestandardizationdepartmentoftheStateCounciluniformlyguides,coordinates,andsupervisesthedevelopmentofindustrystandardsandrelatedmanagementwork.ThestandardizationdepartmentoftheStateCouncilestablishesanationalpublicserviceplatformforstandardsinformationtosupporttherecordationandinformationdisclosureofindustrystandards.第八条国务院有关行政主 管部门统一管理本部门职责范围 内的行业标准，负责行业标准制 定、实施、复审、监督等管理工 作，依法将批准发布的行业标准 报国务院标准化行政主管部门备 案。Article8TherelevantadministrativedepartmentsoftheStateCounciluniformlyadministerindustrystandardswithintheirduties,arechargedwiththedevelopment,implementation,review,andsupervisionofindustrystandards,andreporttheapprovedindustrystandardstothestandardizationdepartmentoftheStateCouncilforrecordationaccordingtothelaw.第九条 行业标准代号及范 围，由国务院标准化行政主管部 门依据国务院有关行政主管部门 的申请及其职责，审查批准并公 布。未经批准公布的行业标准代 号不得使用。Article9Thecodeandscopeofindustrystandardsareexamined,approved,andpublishedbythestandardizationdepartmentoftheStateCouncilaccordingtotheapplicationanddutiesoftherelevantadministrativedepartmentsoftheStateCouncil.Industrystandardcodespublishedwithoutapprovalshallnotbeused.第十条在行业标准制定、 实施过程中存在争议的，由国务 院标准化行政主管部门组织协 商；协商不成的报请国务院标准 化协调机制解决。Article10Ifadisputearisesintheprocessofformulatingandimplementinganindustrystandard,thestandardizationdepartmentoftheStateCouncilshallorganizeaconsultationaboutit;ifthenegotiationfails,itshallbesubmittedtothestandardizationcoordinationmechanismoftheStateCouncilforhandling.第十一条行业标准由国务 院有关行政主管部门制定。制定 行业标准的程序一般包括：立 项、组织起草、征求意见、技术 审查、编号、批准发布、备案。Article11IndustrystandardsshallbeformulatedbytherelevantadministrativedepartmentsoftheStateCouncil.Theproceduresforformulatinganindustrystandardgenerallyincludeprojectinitiation,draftingorganization,publiccommentsolicitation,technicalreview,numbering,approv
