Shorttitleandcommencement1. ThisActistheHealthcareServices(Amendment)Act2023andmesintooperationonadatethattheMinisterappointsbynotificationintheGazette.Amendmentofsection22. Section2(1)oftheHealthcareServicesAct2020(calledinthisActtheprincipalAct)isamended一(a) byinserting,immediatelyafterthedefinitionof,application,jthefollowingdefinitions:u,tapprovednveyancemeansanyconveyanceapprovedundersection11Btobeusedfortheprovisionofalicensablehealthcareservice;“approvedpermanentpremises,jmeansanypermanentpremisesapprovedundersection11Btobeusedfortheprovisionofalicensablehealthcareservice;“approvedspecifiedservice"meansayspecifiedserviceapprovedIJnd成section11Df,;(b) bydeletingthedefinitionofuDirectorandsubstitutingthefollowingdefinition:“"Director-General"meanstheDirector-GeneralofHealthandincludesanyindividualwhois,forthetimebeing,dischargingthedutiesoftheDirector-GeneralofHealth;M;(c) bydeletingthedefinitionsoflicensednveyanceanduIicensedpremisesn;(d) byinserting,immediatelyafterthedefinitionof,toralhealththerapisf,thefollowingdefinition:,u,permanentpremises,linrelationtoanapplicantforalicentoprovidealicensablehealthcareserviceoralicensee,meansanypremisesatwhichtheapplicantorlinsee(asthecasemaybe)intendstoprovidethelicensablehealthcareservicefortheentiretermorremainderoftheterm(asthecasemaybe)ofthelicence;(e) byinserting,immediatelyafterthedefinitionofupublicscheme,thefollowingdefinition:“"remoteprovision,inrelationtoalicensablehealthcareservice,meansprovisionofthelicensablehealthcareservice一(a) toapatientorcustomerwhoisnotphysicallypresentatthesameplaceasanyindividualprovidingthelicensablehealthcareservice;and(b) involvingcommunicationthrough一(i) theInternet;(ii) thetelephoneorothercommunicationdevice;or(iii) anyotherkindofelectronicorothertechnologyforfacilitatingcommunication,butdsnotincludeanyspecificsystemormethodofmmunicatiothatisprescribedtobeexcludedforthepurposesofthisparagraph;M;(f) bydeletingthedefinitionof"speciallicensablehealthcareservicenandsubstitutingthefollowingdefinition:,u,servicedeliverymode,jinrelationtoalicensablehealthcareservice,meansanyofthefollowingmodesbywhichthelicensablehealthcareserviceisprovided:(a) atpermanentpremises;(b) atanypremisesotherthanpermanentpremises;(c) usingaconveyance;(d) byremoteprovision;"and(g) byinserting,immediatelyafterthedefinitionofspecifiedcommittee,jthefollowingdefinition:“"specifiedservice"，inrelationtoalicensablehealthcareservice,meansaserviceofamedicalorhealthcarenatureprescribedundersection9A(1)asaspecifiedserviceforthatlicensablehealthcareservice;".Repealandre-enactmentofsection43. Section4oftheprincipalActisrepealedandthefollowingsectionsubstitutedtherefor:uPurposeofAct4. ThepurposeofthisActistoregulatetheprovisionofhealthcareservices,including一(a) themodesbywhichhealthcareservicesareprovidedandthepremisesandnveyansusedfortheprovisionofhealthcareservices;and(b) theadvertisementofanyhealthcareservice,soastoensurethesafetyandwelfareof,andthegeneralcontinuityofhealthcareprovidedto,peopleinSingapore/*.Repealandre-enactmentofsection94.Section9oftheprincipalActisrepealedandthefollowingsectionsubstitutedtherefor:“Permanentpremises,conveyancesandservicedeliverymodetobeapproved9.(1)Alicenseemustnotprovidealicensablehealthcareservice一(a) atanypermanentpremisesinSingaporethatisnotanapprovedpermanentpremisesfortheprovisionofthelicensablehealthcareservice;(b) usinganynveyancethatisnotanapprovedconveyancefortheprovisionofthelicensablehealthcareservice;or(c) byanyotherservicedeliverymodethatisnotapprovedundersection11Bfortheprovisionofthelicensablehealthcareservice.(2) Alinseethatcontravenessubsection(1)shallbeguiltyofanoffenceandshallbeliableonnvictio(a) inthecaseofafirstoffence,toafinenotexceeding$50,000ortoimprisonmentforatermnotexceeding12monthsortoboth;and(b) ifthelicenseehasapreviousqualifyingconviction,toafinenotexceeding$100,000ortoimprisonmentforatermnotexceeding12monthsortoboth.(3) Insubsection，“qualifyingnvictionmeans一(a) aconvictionforanoffenceundersubsection(2);or(b) anviction(whetherbefore,onorafterthedateofmmencementofsection4oftheHealthcareServices(Amendment)Act2023)foranoffenceunder一(i) section9(1)asinforceimmediatelybeforethatdate;or(ii) section5(2)or(4)(a)oftherepealedAct.".Newsection9A5. TheprincipalActisamendedbyinserting,immediatelyaftersection9,thefollowingsection:uSpecifiedservicetobeapproved(1) (1)TheMinistermayprescribeaserviceofamedicalorhealthcarenaturethatispartofalicensablehealthcareserviceasaspecifiedserviceforthelicensablehealthcareservice,theprovisionofwhichwouldrequireapprovalbytheDirector-Generalundersection11D.(2) Despiteholdingalicencefortheprovisionofalicensablehealthcareservice,alicenseemustnotprovideanyspecifiedserviceforthelicensablehealthcareserviceunlessthelicenseeisgrantedapprovalundersection11Dfortheprovisionofthespecifiedservice.(3) Alicenseethatntravenessubsection(2)sh
