港口危险货物安全管理规定（2017年9月4日交通运输部发布 根据2019年11月28日交通运输 部关于修改港口危险货物安全管理 规定的决定第一次修正根据 2023年8月3日交通运输部关于修 改港口危险货物安全管理规定的 决定第二次修正）第一章总则港口危险货物安全管理规定(2023修正)ProvisionsontheSafetyManagementofHazardousGoodsatPorts(2023Amendment)制定机关：交通运输部发文字号：中华人民共和国交通运输部令2023年第8号公布日期:2023.08.03施行日期：2023.08.03效力位阶：部门规章法规类别：港口港务IssuingAuthority：MinistryofTransportDocumentNumber：OrderNo.82023oftheMinistryofTransportofthePeople'sRepublicofChinaDateIssued：08-03-2023EffectiveDate：08-03-20231.evelofAuthority：DepartmentalRulesAreaofLaw:PortsandPortAdministrativeAffairsProvisionsontheSafetyManagementofHazardousGoodsatPorts(PublishedbytheMinistryofTransportonSeptember4,2017,amendedforthefirsttimeinaccordancewiththeDecisionoftheMinistryofTransporttoAmendtheProvisionsontheSafetyManagementofHazardousGoodsatPortsonNovember28,2019,amendedforthesecondtimeinaccordancewiththeDecisionoftheMinistryofTransporttoAmendtheProvisionsontheSafetyManagementofHazardousGoodsatPortsonAugust3,2023)ChapterIGeneralProvisionsArticle1Forthepurposesofstrengtheningthesafetymanagementofhazardousgoodsatports,preventingandreducingaccidentsofhazardousgoods,protectingthesafetyofpeople,slivesandproperty,andprotectingtheenvironment,theseProvisionsaredevelopedinaccordancewiththeLawonPorts,theWorkSafetyLaw,theRegulationontheSafetyManagementofHazardousChemicalsandotherrelevantlawsandadministrativeregulations.Article2TheseProvisionsshallapplytothenewconstruction,reconstruction,andexpansionofconstructionprojectsofportsforstorage,loadingandunloadingofhazardousgoods(hereinafterreferredtoas''constructionprojectsofportsforhazardousgoods"),andhazardousgoodsoperationsatportsintheterritoryofthePeopledRepublicofChina.Forthepurposeoftheaforesaidparagraph,hazardousgoodsoperationsatportsincludeloading,unloading,lighteringandstorageofhazardousgoodsinportareas.Article3Thesafetymanagementofhazardousgoodsatportsshallbeconductedundertheprinciplesofsafetyfirst,focusingonpreventionandcomprehensivetreatment,andtheprimaryworksafetyresponsibilitiesoftheconstructionentitiesofportconstructionprojectsforhazardousgoodsandportoperatorsshallbestrengthenedandimplemented.第一条为了加强港口危险货物 安全管理，预防和减少危险货物事 故，保障人民生命、财产安全，保护 环境，根据港口法安全生产 法危险化学品安全管理条例等 有关法律、行政法规，制定本规定。第二条 在中华人民共和国境 内，新建、改建、扩建储存、装卸危 险货物的港口建设项目（以下简称危 险货物港口建设项目）和进行危险货 物港口作业，适用本规定。前款所称危险货物港口作业包括在港 区内装卸、过驳、仓储危险货物等行 为。第三条 港口危险货物安全管理 坚持安全第一、预防为主、综合治理 的方针，强化和落实危险货物港口建 设项目的建设单位和港口经营人安全 生产主体责任。危险货物港口建设项目的建设单位和 港口经营人应当建立健全全员安全生 产责任制和安全生产规章制度，加大 对安全生产资金、物资、技术、人员 的投入保障力度，改善安全生产条Constructionentitiesandportoperatorsofconstructionprojectsofportsforhazardousgoodsshallestablishandimprovetheworksafetyresponsibilitysystemandworksafetyrulesandregulationsforallstaffmembers,increasetheinvestmentinandguaranteefortheworksafetyfunds,materials,technology,andpersonnel,improvetheworksafetyconditions,strengthentheworksafetystandardizationandinformationconstruction,establishadualpreventionmechanismforhierarchicalcontrolofsecurityrisksandinvestigationandtreatmentofhiddendangers,improvethemechanismforpreventingandresolvingrisks,improvethelevelofworksafety,andensureworksafety.件，加强安全生产标准化、信息化建 设，构建安全风险分级管控和隐患排 查治理双重预防机制，健全风险防范 化解机制，提高安全生产水平，确保 安全生产。Article4TheMinistryofTransport("MOT")shallberesponsibleforthesafetyindustry第四条交通运输部主管全国港managementofhazardousgoodsatportsacross危险货物安全行业管理工作。thecountry.Thecompetenttransportdepartmentsoftheprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentshallbeinchargeofthesafetysupervisionandmanagementofhazardousgoodsatportswithintheirjurisdictions.Theportadministrativedepartmentsattheprovincial,municipalandcountylevelsshallberesponsibleforthespecificimplementationofthesafetysupervisionandmanagementofhazardousgoodsatports.ChapterIISafetyExaminationofConstructionProjectsArticle 5 Constructionprojectsofportsforhazardousgoodsshallbesubjecttoexaminationofthesafetyconditionsbytheportadministrativedepartment.省、自治区、直辖市交通运输主管部 门主管本辖区的港口危险货物安全监 督管理工作。省、市、县级港口行政管理部门在职 责范围内负责具体实施港口危险货物 安全监督管理工作。第二章建设项目安全审查第五条 危险货物港口建设项目 应当由港口行政管理部门进行安全条 件审查。未通过安全条件审查，危险货物港口 建设项目不得开工建设。Aconstructionprojectofportwithhazardousgoodsfailingtopasstheexaminationofsafetyconditionsshallnotbecommenced.Article 6 Theportadministrativedepartmentattheprovinciallevelshallberesponsiblefortheexaminationofsafetyconditionsofthefollowingportconstructionprojects:(1) portconstructionprojectsinvolvingthestorageorloadingandunloadingofhighlytoxicchemicals;(2) coastalwharfswithnotlessthan50,000tonsofhazardousgoods,wharfsalongtheYangtzeRivertrunkwithnotlessthan3,000tonsofhazardousgoods,andwharfsalongotherinlandwaterswithnotlessthan1,000tonsofhazardousgoods;and(3) hazardousgoodsstoragefacilitieswithtotalcapacityofcoastaltankareaofnotlessthan100,000cubicmetersandtotalcapacityofinlandwatertankareaofnotlessthan5,000cubicmeters.Forotherconstructionprojectsofportswithhazardousgoods,theportadministrativedepartmentsatthedistrictedcitylevelintheplacewheretheprojectsarelocatedshallbere
