【制定机关】 【发文字号】 【公布日期】 【施行日期】 【效力位阶】 【法规类别】进口商品残损检验鉴定管 理办法（2007年7月6日国家质 量监督检验检疫总局令第 97号公布 根据2018年4 月28日海关总署令第238 号海关总署关于修改部 分规章的决定第一次修 正根据2023年3月9日 海关总署令第262号海 关总署关于修改部分规章 的决定第二次修正）第一章总则第一条为加强进口 商品残损检验鉴定工作， 规范海关和社会各类检验 机构进口商品残损检验鉴进口商品残损检验鉴定管理办法（2023修正）AdministrativeMeasuresfortheInspectionandAuthenticationoftheDamagetoImportCommodities(2023Amendment)海关总署中华人民共和国海关总署令第262号2023.03.092023.04.15部门规章进出口商品监督与管理Issuingauthority:InstrumentalitiesoftheStateCounciLAllAgencies1GeneralAdministrationofCustomsDocumentNumber:OrderNo.262oftheGeneralAdministrationofCustomsofthePeople,sRepublicofChinaDateissued:03-09-2023Effectivedate:04-15-20231.evelofAuthority:DepartmentalRulesAreaofLaw:CommodityInspection,AnimalandPlantQuarantineAdministrativeMeasuresfortheInspectionandAuthenticationoftheDamagetoImportCommodities(PromulgatedbyOrderNo.97oftheStateAdministrationofQualitySupervision,InspectionandQuarantineonJuly6,2007;amendedaccordingtotheDecisionoftheGeneralAdministrationofCustomstoAmendSomeRulesbyOrderNo.238oftheGeneralAdministrationofCustomsonApril28,2018;andamendedaccordingtotheDecisionoftheGeneralAdministrationofCustomstoAmendSomeRulesbyOrderNo.262oftheGeneralAdministrationofCustomsofthePeople'sRepublicofChinaonMarch9,2023)ChapterIGeneralProvisionsArticle 1 TheseMeasuresareenactedaccordingtotheLawofthePeople'sRepublicofChinaonImportandExportCommodityInspectionandtheregulationontheimnlomontatinnthnrnnfcnllcnthnr定行为，维护社会公共利 益和进口贸易有关各方的 合法权益，促进对外贸易 的顺利发展，根据中华 人民共和国进出口商品检 验法及其实施条例，以 及其他相关法律、行政法 规的规定，制订本办法。relevantlawsandadministrativeregulationsforthepurposeofstrengtheningtheinspectionandauthenticationofthedamagetoimportcommodities,regulatingtheinspectionandauthenticationofthedamagetoimportcommoditiesbytheCustomsandvarioussocialinspectioninstitutions,maintainingsocialpublicinterestsandthelegitimaterightsandinterestsofallthepartiesinvolvedinimporttrade,andpromotingthesmoothdevelopmentofforeigntrade.第二条本办法适用 于中华人民共和国境内的 进口商品残损检验鉴定活 动。第三条海关总署主 管全国进口商品残损检验 鉴定工作，主管海关负责 所辖地区的进口商品残损 检验鉴定及其监督管理工 作。Article 2 TheseMeasuresareapplicabletotheinspectionandauthenticationofthedamagetoimportcommoditieswithintheterritoryofthePeople,sRepublicofChina.第四条主管海关负 责对法定检验进口商品的 残损检验鉴定工作。法检 商品以外的其他进口商品 发生残损需要进行残损检 验鉴定的，对外贸易关系 人可以向主管海关申请残 损检验鉴定，也可以向依 法设立的检验机构申请残 损检验鉴定。Article3TheGeneralAdministrationofCustomsshalltakechargeoftheinspectionandauthenticationofthedamagetoimportcommoditiesacrossthecountry,andthecompetentcustomsofficesshallberesponsiblefortheinspectionandauthenticationofthedamagetoimportcommoditieswithintheirrespectivejurisdictionsandtherelevantsupervisoryandadministrativework.Article4Thecompetentcustomsofficesshallberesponsiblefortheinspectionandauthenticationofthedamagetoimportcommoditiessubjecttocompulsoryinspection.Incasetheimportcommoditiesotherthanthosesubjecttocompulsoryinspectionaredamagedandtheinspectionandauthenticationofthedamageisthusrequired,thepartyinvolvedinforeigntrademayfileanapplicationforinspectingandauthenticatingthedamagewiththecompetentcustomsofficesorwiththeinspectioninstitutionlegallyformed.TheCustomsinvariousregionsshallsuperviseandadministratetheinspectionandauthenticationofthedamageascarriedoutbyinspectioninstitutions.Article5TheCustomsshallinspectandauthenticatethedamagetothefollowingdamagedimportcommoditieswhenneeded:(1) .Theimportcommoditiesthathavebeenincorporatedintothecatalogueofentry-exitcommoditiesforwhichtheCustomsshallcarryouttheinspectionandquarantine.(2) .Theconsigneeoranyotherpartyinvolvedintradeoftheimportcommoditiesotherthanthosesubjecttocompulsoryinspectionfindsthattheimportcommoditiesarenotuptostandards,aredamagedorrunshort,andthusappliesfortheissuanceofacertificate.(3) .Thedangerousgoods,wasteandoldarticlesasimported.(4) .TheimportcommoditiesforwhichtheverificationmanagementorquotamanagementisimplementedandtheinspectionneedstobecarriedoutbytheCustoms.(5) .Theimportcommoditiessuspectedofbeinginvolvedinfraud.(6) .TheimportcommoditiesforwhichtheconsigneeoranyotherpartyinvolvedintraderequirestheCustomstoissueacertificateforcompensation.海关对检验机构的残损检 验鉴定行为进行监督管 理。第五条海关根据需 要对有残损的下列进口商 品实施残损检验鉴定：（一）列入海关必须实施 检验检疫的进出境商品目 录内的进口商品；（二）法定检验以外的进 口商品的收货人或者其他 贸易关系人，发现进口商 品质量不合格或者残损、 短缺，申请出证的；（三）进口的危险品、废 旧物品；（四）实行验证管理、配 额管理，并需由海关检验 的进口商品；（五）涉嫌有欺诈行为的 进口商品；（六）收货人或者其他贸 易关系人需要海关出证索 赔的进口商品；（七）双边、多边协议协 定、国际条约规定，或国 际组织委托、指定的进口 商品；(7) .Theimportcommoditiesasprovidedbybilateralormultilateralagreementsorconventions,internationaltreaties,orasauthorizedordesignatedbyinternationalorganizations.(8) .OtherimportcommoditiessubjecttotheinspectionoftheCustomsaccordingtorelevantlawsoradministrativeregulations.ChapterIlDeclarationArticle6Incasetheimportcommoditiessubjecttocompulsoryinspectionaredamagedandtheinspectionandauthenticationofdamageisthusrequired,theconsigneeshallapplytothecompetentcustomsofficesfortheinspectionandauthenticationofdamage.Incasetheimportcommoditiesotherthanthosesubjecttocompulsoryinspectionaredamaged
