海南自由贸易港三亚中央商务区条例RegulationonSanyaCentralBusinessDistrictoftheHainanFreeTradePort制定机关：海南省人大(含常委会)发文字号：海南省人民代表大会常务委员会公告第15号公布日期：2023.09.19施行日期：2023.10.01效力位阶：省级地方性法规法规类别：商贸物资综合规定营商环境优化IssuingAuthority：HainanProvincePeople'sCongress(incl.StandingCommittee)DocumentNumber：AnnouncementNo.15oftheStandingCommitteeofthePeople'sCongressofHainanProvinceDateIssued：09-19-2023EffectiveDate:10-01-20231.evelofAuthority：ProvincialLocalRegulationsAreaofLaw:GeneralProvisionsonTrade&CommerceMaterialsOptimizationofDoingBusiness海南省人民代表大会常务委员会公 告AnnouncementoftheStandingCommitteeofthePeople'sCongressofHainanProvince(No. 15)（第15号）海南自由贸易港三亚中央商务区 条例已由海南省第七届人民代表 大会常务委员会第六次会议于2023 年9月19日通过，现予公布，自 2023年10月1日起施行。TheRegulationonSanyaCentralBusinessDistrictoftheHainanFreeTradePort,asadoptedatthe6thSessionoftheStandingCommitteeoftheSeventhPeople'sCongressofHainanProvinceonSeptember19,2023,isherebyissued,andshallcomeintoforceonOctober1,2023.p0pl's海南省人民代表大会常务委员会StandingCommitteeoftheCongressofHainanProvinceSeptember19,2023RegulationonSanyaCentralBusinessDistrictoftheHainanFreeTradePort(Adoptedatthe6thSessionoftheStandingCommitteeoftheSeventhPeople'sCongressofHainanProvinceonSeptember19,2023)Article1ThisRegulationisdevelopedinaccordancewiththerelevantlawsandregulationsandinlightoftheactualcircumstancesoftheHainanFreeTradePorttopromotethehigh-qualitydevelopmentofSanyaCentralBusinessDistrict(CBD)oftheHainanFreeTradePort.Article2SanyaCBDincludesthePhoenixCoastUnitofTianyaDistrict,Dong'anUnit,YuechuanUnit,HailuoUnit,andotherareasofJiyangDistrictofSanyaCity,andthespecificscopeshallbedemarcated,adjusted,andannouncedbythePeople'sGovernmentofSanyaCityinaccordancewiththerelevantprocedures.2023年9月19日海南自由贸易港三亚中央商务区条 例（2023年9月19日海南省第七届 人民代表大会常务委员会第六次会 议通过）第一条为了促进海南自由贸 易港三亚中央商务区高质量发展， 根据有关法律法规，结合海南自由 贸易港实际，制定本条例Q第二条 三亚中央商务区包括 三亚市天涯区的凤凰海岸单元和吉 阳区的东岸单元、月川单元、海罗 单元等片区，具体范围由三亚市人 民政府依照有关程序划定、调整并 公布。三亚中央商务区应当按照海南自由 贸易港建设的有关要求，对标世界 最高水平开放形态，创新体制机 制，在国际合作、开发建设、产业 发展、投资促进、产城融合、制度 创新等方面先行先试，构建以总部 经济、金融服务、现代商贸、邮轮 游艇、专业服务、文化休闲等为重 点产业的发展体系，打造现代服务 业创新发展试验区。SanyaCBDshall,inaccordancewiththerelevantrequirementsfortheconstructionoftheHainanFreeTradePort,openuptotheworldatthehighestlevel,innovateitssystemsandmechanisms,andcarryoutpilotprogramsinaspectssuchasinternationalcooperation,developmentandconstruction,industrydevelopment,investmentpromotion,industry-urbanintegration,andinstitutionalinnovation,buildadevelopmentsystemtakingheadquarterseconomy,financialservices,moderncommerceandtrade,cruiseshipsandyachts,professionalservices,andcultureandleisure,amongothers,askeyindustriestocreateapilotzonefortheinnovativedevelopmentofthemodernserviceindustry.Article3Theprovincialpeople'sgovernmentandthePeople'sGovernmentofSanyaCityshallstrengthentheleadershipovertheworkofSanyaCBD,coordinatetheresolutionofmajorissuesinconstructionanddevelopment,decideonmajorissuesandmajorprojects,andestablishandimprovethemechanismsforassessmentandevaluation,rewardsandpunishments.Theprovincialpeople'sgovernmentandthePeople'sGovernmentofSanyaCityandtheirrelevantdepartmentsshallsupporttheconstructionanddevelopmentofSanyaCBDinaspectssuchassysteminnovation,infrastructureconstruction,industrydevelopment,land,taxation,finance,andtalentintroduction.Thedistrictpeople'sgovernmentattheplacewhereSanyaCBDislocatedshallberesponsibleforexercisingthesocialmanagementfunctionsofSanyaCBD.第三条省人民政府和三亚市 人民政府应当加强对三亚中央商务 区工作的领导，协调解决建设发展 中的重大问题，决定重大事项和重 大项目，建立健全考核评价奖惩机 制。省人民政府和三亚市人民政府及其 有关部门应当在制度创新、基础设 施建设、产业发展、土地、财税、 金融和人才引进等方面支持三亚中 央商务区建设与发展。三亚中央商务区所在地的区人民政 府负责行使三亚中央商务区的社会 管理职能。第四条 三亚市人民政府在三 亚中央商务区依法设立管理机构。 管理机构是在三亚中央商务区履行 相应行政管理和公共服务职责的法 定机构，具体负责三亚中央商务区 的综合协调、开发建设、运营管 理、产业发展、制度创新、投资促 进、营商环境建设等工作，依照授 权或者委托行使相应事权。Article4ThePeople'sGovernmentofSanyaCityshallestablishamanagementinstitutioninSanyaCBDinaccordancewiththelaw.ThemanagementinstitutionisastatutoryinstitutionthatperformscorrespondingadministrativemanagementandpublicservicedutiesinSanyaCBD,isspecificallyresponsibleforsuchworkascomprehensivecoordination,developmentandconstruction,operationandmanagement,industrydevelopment,systeminnovation,investmentpromotion,andbusinessenvironmentconstructioninSanyaCBD,andexercisescorrespondingpowersaccordingtoauthorizationorentrustment.Exceptforpersonnelappointedinaccordancewithrelevantprovisions,themanagementinstitutionofSanyaCBDshall,undertheprincipleofsimplificationandefficiency,implementanenterprise-orientedandmarket-orientedemploymentmechanismandremunerationsystemwithintheapprovedscopeoftotalremunerationinaccordancewithrelevantprovisions,andindependentlydeterminetheorganizationalstructure,postsetup,personnelrecruitment,andremunerationstandards,amongothers.Thepersonsincharge,officers,andotherpersonnelofthemanagementinstitutionofSanyaCBDmaybeappointedfromabroad.Article5Theprovincialpeople'sgovernmentandthePeople'sGovernmentofSanyaCityandtheirrelevantdepartmentsshalldelegateorentrustthemanagementinstitutionofSanyaCBDtoexercisetherelevantadmi
