城市道路管理条例（1996年6月4日中华人民共和 国国务院令第198号发布根据 2011年1月8日国务院关于废 止和修改部分行政法规的决定 第一次修订 根据2017年3月1 日国务院关于修改和废止部分 行政法规的决定第二次修订 根据2019年3月24日国务院 关于修改部分行政法规的决定 第三次修订）城市道路管理条例(2019修订)RegulationsonAdministrationofUrbanRoads(2019Revision)制定机关：国务院发文字号：中华人民共和国国务院令第710号公布日期:2019.03.24施行日期：2019.03.24效力位阶：行政法规法规类别：市政公用与路桥IssuingAuthority：StateCouncilDocumentNumber:OrderNo.710oftheStateCouncilofthePeople'sRepublicofChinaDateIssued：03-24-2019EffectiveDate：03-24-20191.evelofAuthority：AdministrativeRegulationsAreaofLaw：MunicipalPublicUtilities,Highways,andBridgesRegulationsonAdministrationofUrbanRoads(PromulgatedbyOrderNo.198oftheStateCouncilofthePeople'sRepublicofChinaonJune4,1996;revisedforthefirsttimeinaccordancewiththeDecisionoftheStateCouncilonAbolishingandAmendingSomeAdministrationRegulationsonJanuary8,2011;revisedforthesecondtimeinaccordancewiththeDecisionoftheStateCounciltoAmendandRepealCertainAdministrativeRegulationsonMarch1,2017;andrevisedforthethirdtimeinaccordancewiththeDecisionoftheStateCounciltoAmendCertainAdministrativeRegulationsonMarch24,2019)第一条为了加强城市道路 管理，保障城市道路完好，充分 发挥城市道路功能，促进城市经 济和社会发展，制定本条例。第二条本条例所称城市道 路，是指城市供车辆、行人通行 的，具备一定技术条件的道路、 桥梁及其附属设施。第三条本条例适用于城市 道路规划、建设、养护、维修和 路政管理。第四条城市道路管理实行 统一规划、配套建设、协调发展 和建设、养护、管理并重的原 则。第五条国家鼓励和支持城 市道路科学技术研究，推广先进 技术，提高城市道路管理的科学 技术水平。第六条国务院建设行政主 管部门主管全国城市道路管理工 作。省、自治区人民政府城市建设行 政主管部门主管本行政区域内的 城市道路管理工作。Article1TheseRegulationsareformulatedforthepurposeofenhancingtheadministrationofurbanroads,ensuringthegoodconditionofurbanroads,bringingthefunctionsofurbanroadsintofullplay,andpromotingurbaneconomicandsocialdevelopment.Article2UrbanroadsreferredtointheseRegulationsmeanroads,bridgesandauxiliaryfacilitiesthereofwithcertaintechnicalconditionsincitieswhichareusedforvehiclesandpedestrianstopassthrough.Article3TheseRegulationsareapplicabletourbanroadplanning,construction,maintenance,serviceandroadadministration.Article4Theadministrationofurbanroadsshallapplytheprinciplesofunifiedplanning,matchingfacilityconstruction,coordinateddevelopmentandofpayingequalattentiontoconstruction,maintenanceandadministration.Article5TheStateencouragesandsupportsthescientificandtechnicalresearchintourbanroads,andthedisseminationofadvancedtechnologiesandtheupgradingofthescientificandtechnicallevelintheadministrationofurbanroads.Article6ThecompetentconstructionadministrativedepartmentoftheStateCouncilisinchargeoftheworkofadministrationofurbanroadsinthewholecountry.Thecompetenturbanconstructionadministrativedepartmentsofthepeople,sgovernmentsofprovincesandautonomousregionsareinchargeoftheworkofadministrationofurbanroadsintheirrespectiveadministrativeareas.Thecompetentmunicipalengineeringadministrativedepartmentsofthepeople'sgovernmentsofthecitiesatorabovethecountylevelareinchargeoftheworkofadministrationofurbanroadswithintheirrespectiveadministrativeareas.ChapterIlPlanningandConstructionArticle7Thepeople'sgovernmentsofcitiesatorabovethecountylevelshallorganizethedepartmentsofmunicipalengineering,urbanplanning,publicsecurityandcommunicationstoworkout,basedontheoverallmunicipalplanning,theurbanroaddevelopmentplanning.Thecompetentadministrativedepartmentsofmunicipalengineeringshallproduce,basedontheurbanroaddevelopmentplanning,theannualplanforurbanroadconstruction,whichW川beimplementedupontheapprovalbythecitygovernments.Article8Thefundsforurbanroadconstructionmayberaised,inaccordancewithrelevantprovisionsoftheState,throughsuchchannelsasgovernmentinvestment,raisingfunds,domesticorforeignloans,revenuederivedfromthecompensateduseofState-ownedlandandtheissuanceofbonds.县级以上城市人民政府市政工程行政主管部门主管本行政区域内的城市道路管理工作。第二章规划和建设第七条县级以上城市人民政府应当组织市政工程、城市规划、公安交通等部门，根据城市总体规划编制城市道路发展规划。市政工程行政主管部门应当根据城市道路发展规划，制定城市道路年度建设计划，经城市人民政府批准后实施。第八条城市道路建设资金可以按照国家有关规定，采取政府投资、集资、国内外贷款、国有土地有偿使用收入、发行债券等多种渠道筹集。Article9Theconstructionofurbanroadsshallcomplywiththetechnicalstandardsforurbanroads.第九条城市道路的建设应当符合城市道路技术规范。第十条政府投资建设城市 道路的，应当根据城市道路发展 规划和年度建设计划，由市政工 程行政主管部门组织建设。Article 10 Wherethegovernmentinvestsintheconstructionofurbanroads,thecompetentadministrativedepartmentofmunicipalengineeringshall,basedontheurbanroaddevelopmentplanningandtheannualconstructionplan,organizetheconstructionthereof.单位投资建设城市道路的，应当 符合城市道路发展规划。Whereanentityinvestsintheconstructionofurbanroads,thegeneralplanforurbanroaddevelopmentshallbecompliedwith.城市住宅小区、开发区内的道路 建设，应当分别纳入住宅小区、 开发区的开发建设计划配套建 设。Theroadsinurbanresidentialquartersanddevelopmentzonesshallberespectivelyincorporatedintotheconstructionplanoftheresidentialquartersanddevelopmentzones,andbebuiltasmatchingfacilitiestherefor.第十一条国家鼓励国内外 企业和其他组织以及个人按照城 市道路发展规划，投资建设城市 道路。Article 11 TheStateencouragestheinvestmentintheconstructionofurbanroadsbydomesticandforeignenterprisesandotherorganizationsaswellasindividualsaccordingtotheurbanroaddevelopmentplanning.第十二条城市供水、排 水、燃气、热力、供电、通信、 消防等依附于城市道路的各种管 线、杆线等设施的建设计划，应 当与城市道路发展规划和年度建 设计划相协调，坚持先地下、后 地上的施工原则，与城市
