2023ProcuratorialWhitePaperonIntellectualPropertyinShanghaiReleasedbyShanghaiPeople,sProcuratorateAstheintellectualproperty(hereinafterreferredtoastheTP'')isakeyelementofthenewqualityproductiveforces,theIPprotectionmustbestrengthenedindevelopmentofsuchforces.Atpresent,ShanghaiiswitnessingaccelerationofconstructionofaninternationalcenterfortechnologyandinnovationaswellasbuildingoftheIPprotectionhighlandandthatofaninternationalIPcentralcity.Theprocuratoratewillperformthehigh-qualityandhigh-efficiencyprocuratorialfunctionstoenablenewachievementsinIPprotectionsothatinnovativevigorcanbemotivatedandaninnovativeenvironmentcanbecreated.Today(April23),ShanghaiPeople'sProcuratorateholdsapressconferencetoreleasethe2023ProciiratoraiWhitePaperonIntellectualPropertyinShanghaiintheChineseandEnglishversion.Basedonananalysisofthecriminal,civil,administrative,public-interestIPlitigationcaseshandledbythepropcuratoratesinShanghaiin2023,westudynewchangesandtrendsoccurredintheIPdevelopmentandprotectiontosuggestcounter-measuresandrecommendationsonconsolidationofthecomprehensivejudicialIPprotectionwithaviewtoprovidingsubstantiallyoptimizedincomparisonwith2022.ComprehensiveexaminationoftheIPcaseswasstrengthened,leadingtoprosecutionof20personsonsuspicionoftheIPinfringementinothercriminalcases.Intermsoftheeffectivejudgmentsrenderedbythecourt,thosewhoweresentencedtominimumthree-yearfixed-termimprisonmentaccountedfor43.9%,indicatingstrengtheningoftheproperty-relatedpenalty.2. SignificantchangesintheIP-infringementcriminalstructure.Firstly,althoughthenumberofthetrademarkinfringementcasesstillrankedthetopincriminalcases,itsproportionfurtherdroppedto88.8%.Amongotherthings,therewere873casesofsellingcommoditywithcounterfeitregisteredtrademarksinvolving1,579perpetrators,rankingthetopinvarioustrademark-infringementcharges.Therewerealso298casesofcounterfeitingregisteredtrademarksinvolving744perpetratorsand45casesofillegalmanufactureandsalesofillegallyproducedregisteredtrademarksandlogosinvolving124perpetratorsSecondly,the"quantityrelativeratioofthecopyright-infringementcasesroseunanimously,accountingfor9.4%from5.3%in2022incriminalcases.Amongotherthings,therewere105casesofcopyrightinfringementinvolving261perpetrators,thenumberofwhichroseby1.8timesincomparisonwith2022.Therewere24casesofsalesofpiratecopiesinvolving46perpetrators,thenumberofwhichrosebyfivetimesincomparisonwith2022.Thirdly,casesofinfringementofbusinesssecretswereontherise,accountingfor1.8%incriminalcases.Therewere24casesofinfringementofbusinesssecretsinvolving56perpetrators,thenumberofwhichroseby60%incomparisonwith2022.ThefirstcaseofillegalspyingandprovisionofbusinesssecretsforoverseasorganizationswashandledinShanghaiasofimplementationoftheAmendments(XI)totheCriminal1.aw.Changesinthecriminalstructurewerecausedby,ononehand,frequentoccurrenceofnew-typecasessuchasthecopyrightandthebusinesssecretinfringementresultedfromincreasingdevelopmentintheneweconomyandhightechnology;ontheotherhand,improvementinthejudicialorgans'powerfullyprofessionalcapabilitiesofcrackingandhandlingofcasesaswellasgradualmanifestationofachievementsintheservicesforscienceandtechnologyinnovationcentersandtheculturalprosperityandinnovation.3. Deeperfulfillmentofthelegalsupervisionofthecriminalproceedings.Pre-interventioninthefrontendofhardcaseswasfullyimplementedaimingatthefeaturesoftheIP-infringementcriminalcases,i.e.easilyperishableevidenceandtimelinessofevidencecollection.Relyingonmechanismsincludingtheofficeofinvestigationsupervisionandcollaboration,wesupervisedregistrationof283casesaswellaspursuitandprosecutionof213perpetrators,72ofwhomweresentencedtominimumthree-yearfixed-termimprisonment.Transferof52casesonsuspicionoftheIPinfringementtothepolicebytheadministrativeauthoritieswassuggested.50ofwhichwasregisteredforinvestigation.Twocriminalcaseswereprotested.Judgmentagainstoneofthemwasamended.4. SolidprogressesweremadeincivilandadministrativeIPsupervisionandtheIPpublic-interestlitigationwassteadilyexpanded.Therewere28civilsupervisioncasesincludingtwocaseswhereprocuratorialsuggestionsonarelrialweremadeand15caseswhereprocuratorialsuggestionsonrectificationofviolationofthelawweremade.Moreover,thereweretwocasesinvolvingSUPerViSiOnofnon-litigationadministrativeenforcementwhereprocuratorialsuggestionsonrectificationofviolationofthelawwerebothmade.Inaddition,therewere17IPpublic-interestlitigationcasesincluding11civilcasesandsixadministrativeones.Pre-Iitigationprocuratorialsuggestionsweremadeinfivecaseswheretheadministrativeauthoritieshavealltakenrectificationmeasuresandperformeddutiesinaccordancewiththelaw.5. ComprehensiveperformanceofprocuratorialfunctionsintheIPrealmwasfullydeepened,featuringincreasinglydiversemeans.Thecomprehensiveprocuratorialfunctionswereperformedinhandlingof129casesbytheprocuratoratesinShanghai,including115casesreverselytransferredtoadministrativeauthoritiesforpunishmentafternolleprosequi,11casesofincidentalcivilactions,twoprosecution-supportedcasesandtwocasesofpublic-interestadmin
