工程合同中承包人采购材料与工程设备条款（中英文对照）工程合同中承包人采购材料与工程设备条款（中英文对照）MATERIA1.SANDP1.ANTSUPP1.IEDBYCONTRACTOR承包人采购材料与工程设备MaterialandEquipmentPurchasedbyContractor承包人负责采购材料、工程设备的，应按照设计和有关标准要求采购，并提供产品合格证明及出厂证明，对材料、工程设备质量负责。合同约定由承包人采购的材料、工程设备,发包人不得指定生产厂家或供应商,发包人违反本款约定指定生产厂家或供应商的，承包人有权拒绝，并由发包人承担相应责任。Wherethecontractorisresponsiblefortheprocurementofmaterials,engineeringequipment,thecontractorshalleffecttheprocurementpursuanttothedesignandrelevantstandard,submitcertificateofproductqualificationandcertificateofmerchandise,andliableforthequalityofmaterialandengineeringequipment.Providedthattheprocurementofmaterialsandengineeringequipmenteffectedbythecontractorundercontract,theemployershallnotdesignatethemanufacturerorsupplier,ifztheemployerviolatesthisarticlehereoffordesignationofmanufacturerorsupplier,thecontractorreservetherighttorefuseandthecorrespondingresponsibilitywillbebornbytheemployer.发包人应按发包人供应材料设备一览表约定的内容提供材料和工程设备，并向承包人提供产品合格证明及出厂证明，对其质量负责。发包人应提前24小时以书面形式通知承包人、监理人材料和工程设备到货时间，承包人负责材料和工程设备的清点、检验和接收。Theemployershould,pursuanttothecontentsstipulatedin1.istofMaterialsandEquipmentsuppliedbytheemployer,furnishmaterialsandengineeringequipmentbeingaccompaniedbythecertificateofproductqualificationandcertificateofmerchandise,andberesponsibleforthequalitythereof.Theemployershould,on24hourspriorwrittennoticetothecontractorandthesupervisor,informthearrivaltimeofmaterialsandengineeringequipmentandthecontractorshallberesponsiblefortheinventory,inspectionandacceptanceofmaterialsandequipment.发包人提供的材料和工程设备的规格、数量或质量不符合合同约定的，或因发包人原因导致交货日期延误或交货地点变更等情况的，按照第16.1款发包人违约约定办理。Providedthatthespecifications,quantityorqualityofthematerialsandengineeringequipmentwhicharesuppliedbytheemployerarefoundnotinconformitywiththedescriptionsetoutincontractordelayofdeliverydateorchangeofdeliveryplaceandothermatters,willbeprocessedunderarticle16.1Employer'sBreach.承包人采购的材料和工程设备，应保证产品质量合格，承包人应在材料和工程设备到货前24小时通知监理人检验。承包人进行永久设备、材料的制造和生产的，应符合相关质量标准，并向监理人提交材料的样本以及有关资料，并应在使用该材料或工程设备之前监理人同意。Wheretheprocurementofmaterialsandengineeringequipmentiseffectedbythecontractorwhoshouldguaranteethequalityoftheproducts,thecontractorshould,on24hoursbeforearrivalofmaterialsandequipment,givenoticetothesupervisorforinspectionthereof.Incasethatthecontractoreffectthemanufactureandproductionofpermanentequipment,material,thecontractorshallabidebyrelevantqualitystandards,andsubmitmaterialsampleandrelevantinformationtothesupervisor,andshallacquirethesupervisor'sconsentbeforeusingthematerialandequipment.承包人采购的材料和工程设备不符合设计或有关标准要求时，承包人应在监理人要求的合理期限内将不符合设计或有关标准要求的材料、工程设备运出施工现场，并重新采购符合要求的材料、工程设备，由此增加的费用和（或）延误的工期，由承包人承担。Intheeventthatthematerialsandengineeringequipmentwhicharepurchasedbythecontractordonotmeetthedesignorrelevantstandard,thecontractorshould,withinthereasonableperiodoftimerequiredbythesupervisor,movethematerialsandengineeringequipmentwhichnotmeetthedesignorrelevantstandardfromworksite,andeffectre-procurementofthematerialandequipmentwhichareconformitywiththerequirement,theaddedexpenseand/ordelayedtermwillbebornbythecontractor.乙方采购材料设备MaterialsandequipmentsuppliedbyPartyB乙方负责采购材料设备的，应按照合同条款约定及设计和有关标准要求采购，并提供产品合格证明，对材料设备质量负责。乙方在材料设备到货前24小时通知甲方代表清点。WherePartyBisresponsibletosourcethematerialsandequipmentsuchsourcingshallbecarriedoutinaccordancewiththeagreementsanddesignintheContractaswellastheapplicablestandardsandrequirementswithrelevantcertificatesofconformityofthematerialsandequipmentandPartyBshallberesponsiblefortheirquality.PartyBshallinformPartyAtocheckthematerialsandequipmentwithin24hourspriortotheirarrival.乙方采购的材料设备与设计标准要求不符时，乙方应按甲方代表要求的时间运出施工场地，重新采购符合要求的产品，承担由此发生的费用，由此延误的工期不予顺延。WhenthematerialsandequipmentsourcedbyPartyBdoesnotconformtothedesignstandardsorrequirements,PartyBshallremovethematerialsandequipmentfromtheconstructionsitewithinthedeadlinegivenbyPartyAandre-procureproductsuptostandardsandbearalltheexpensesincurredtherefrom.Howeverzthescheduleofconstructionprogressshallnotbepostponed.乙方采购的材料设备在使用前，乙方应按甲方代表的要求进行检验或试验，不合格的不得使用，检验或试验费用由乙方承担。PartyBshalltestorinspectthematerialsandequipmentitprocuredatitsowncostbeforeputtingthemintouse;PartyBshallnotuseanymaterialsandequipmentsubstandard.承包人也应当完成下列工作：为工程采购和供应合同书中规定的设备和材料；TheContractorshallalsocompletethefollowingworks:PurchaseandsupplytheequipmentandmaterialsassetoutintheContractfortheProject;除了业主根据第X条提供的项目和设施，承包商应提供所有为使工厂成功建造所必需的设备、材料、工具、设施、劳工和服务。TheContractorshallprovideallequipment,materials,tools,facilities,labourandservicesnecessaryforthesuccessfulconstructionofthePlantexceptthoseitemsandfacilitiestobesuppliedbytheOwnerunderArticle.根据甲方要求，乙方应为其所购买的工程材料向甲方提交材料的合格证以及质量检测报告。如果乙方提供的材料与合格证和质量检测报告不一致，例如价高质劣，以次充好，或假冒伪劣，乙方将被处以罚金，罚金将是工程总价款的30%oPartyBshouldsubmittoPartyAtheQAcertificateandReportofQualityAssuranceTestforthematerialsithaspurchased;intheeventofthematerialsprovidedbyPartyBdiffersfromtheQAcertificateandtheReportofQualityAssuranceTest,forinstance,productswithpoorqualityandhighprice,inferiormaterialsfakedassuperioroneszorcounterfeitedproducts,PartyBshallbefinedat
